Medical malpractice & medical negligence are the same
The terms medical malpractice and medical negligence are interchangeable, and cover malpractice by a doctor, a nurse, hospital staff, home health care, and just about anyone providing health care. Medical malpractice is defined by the law as Negligence is the failure to use reasonable care. Reasonable care on the part of a physician, hospital or health care provider is that level of care, skill, and treatment which, in light of all relevant surrounding circumstances, is recognized as acceptable and appropriate by similar and reasonably careful physicians, hospitals or health care providers.
Negligence on the part of a physician, hospital or health care provider is doing something that a reasonably careful physician, hospital or health care provider would not do under like circumstances or failing to do something that a reasonably careful physician, hospital or health care provider would do under like circumstances
